Overview
Pursuant to the Personal Data Protection Act 2010 (“PDPA”), FlashPay Sdn. Bhd. is mindful and committed to the protection of your personal information and your privacy. Flashpay the right to amend this Notice to client at any time and will place a notice of such amendments on the company website (www.flashpay.my) or via any other mode the company views suitable, which will be clearly informed to you.
Purpose of processing
FlashPay processes your personal data only for specific and limited purposes.
You agree that all personal data collected and/or processed by FlashPay may include but not be limited to the following purposes:
- To communicate with you;
- To inform you of our products and services;
- Respond to your inquiries and complaints and to generally resolve disputes;
- To send you promotional material;
- To process applications for and the provision of VE Services Products and/or Services;
- For marketing purposes and research purposes;
- Settlement of fund, Refund or Cancellation, Dispute and/or Chargeback of the payment transaction;
- General administration and Manage and maintain your account(s) and facility(ies) with us;
- Update, consolidate and improve the accuracy of our records;
- Recurring payment service and/or tokenization;
- Conduct research and survey, which solely for analytical purposes including but not limited to data mining and analysis of your transactions with us;
- Meet the disclosure requirements of any law binding on us;
- For audit, compliance and risk management purposes;
- Any other purpose that we deem necessary and/or as required or permitted by any law, regulations,
- guidelines and/or relevant regulatory authorities.
An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
Disclosure to third parties
FlashPay may disclose your personal data to our affiliates or third parties that perform services on FlashPay behalf and in doing so we will comply with all applicable laws, regulations and industry standards.
Refund Policy
PART A – CANCELLATION
(a) Before Delivery of Product
A Shopper may cancel their purchases without the Seller’s approval at any time before the Product status on the Website is stated as “Processing”.
(b) During Preparations for Delivery
Once preparations for delivery of the Product are in progress (where the status on the Website is stated as “Processing”), any cancellation will require the Seller’s approval, subject always to the terms of the Seller Agreement.
(c) After Delivery of Product
Once a Product has been shipped out, the status for the order on the Website shall be changed to “Shipped” on the Website. The order can no longer be cancelled at this point, and any cancellation will need to be made via the return process as set out in Part B of this Policy.
PART B – RETURNS, REFUNDS AND EXCHANGES
I – Entitlement for Returns, Refunds and Exchanges
Entitlement for Refund/Exchange – Defective or Non-Compliant Product
Shopper shall be entitled to a refund or exchange of a Product in the following situations:
1. (a) Product is defective
A Product is defective if it:-
1. (i) is unfit for its intended use;
2. (ii) not fit to be consumed;
3. (iii) has a defective design;
4. (iv) has been defectively assembled or manufactured; and/or
5. (v) is dangerous or harmful for normal use.
2. (b) Product does not comply with description/criteria
A refund or exchange is allowed if the delivered Product:
1. (i) is a different or the wrong product;
2. (ii) has different specifications from that advertised or ordered, such as different function, wrong colour or size;
3. (iii) has missing parts; and/or
4. (iv) is missing items promised (such as free gifts).
Non-Returnable/ Non-Exchangeable Products
No request by a Shopper for refund or exchange of a Product in the following categories:-
1. (a) Consumer electronic items;
2. (b) Lingerie, underwear or other intimate apparel;
3. (c) Swimsuits;
4. (d) Beauty products and cosmetics;
5. (e) Fragrances;
6. (f) Customised products;
7. (g) Electronic vouchers (if any) for goods and services (vouchers downloadable immediately upon payment of purchase price);
8. (h) Compact discs (CD) and Digital Video Discs (DVD);
9. (i) Pharmaceutical products; and
10. (j) Perishable foods.
II – Process for Returns, Refunds and Exchanges
Unless otherwise specifically provided under this Policy or the Seller Agreement, the process for refund or exchange of Products shall be as follows:
1. (a) the Shopper submits request for refund or exchange of Product (“Request”) through shopper support
2. (b) the Seller will receive notification from shopper support
3. (c) the Seller must either approve or reject the Request within three (3) Business Days from date of notification;
4. (d) the Shopper returns the Product to the Seller;
5. (e) the Seller shall assess and review the Product returned;
6. (f) based on the condition of the Product returned, the Seller shall either approve or reject the refund or exchange of the Product; and
7. (g) where refund or exchange is approved, the Seller must deliver the new Product or refund the purchase price to the Shopper.
PART C – SUBSCRIPTION RRFUND TERMS
Refund request by the merchant for FlashPay subscription
You are not entitled to a refund for any drop/withdrawal of application after signing up with FlashPay or upon payment of the subscription fee. All fees paid hereunder shall be fully earned by FlashPay and shall be non-refundable for any reason whatsoever.
Refund because of Termination of Service
We reserve the right to terminate your account at any time for any reason in accordance with the Terms of our service and we will not give you a refund for the amount fee that you have paid to us. Similarly, if you terminate our service for whatever reasons, you are not entitled to any refund.
By publishing this policy on this website, we shall deem our customers and/or clients have already been notified.
